I am an attorney in New Jersey. I am currently litigating a proposed class action lawsuit against VW for this exact problem since it is due to defects in the cars (not just passats), this has been confirmed by VW dealerships. We are looking to build the class and to get compensation not just for the repair costs that should have been covered by warranty but were not, but also for the diminished value of the cars.
